Synopsis

Nowadays cosmetic consumers are not just looking for a pleasant, stable, safe, and efficient cosmetic product. Consumers are also looking for sustainable and organic, minimalistic but hybrid, highly-personalised and all-inclusive, mindful and holistic products, which also blur the limits between health and beauty.

At the same time the EU regulatory framework is becoming stricter, and the responsible person has a duty to ensure that the wording of the message communicated is in compliance with the common criteria and is consistent with the documentation in his possession for supporting the claim.

To keep up with all the latest trends, while complying with the legal requirements, can be a very demanding challenge.

Technical document on cosmetic claims provides guidance for the application of Commission Regulation (EU) No 655/2013 laying down common criteria for the justification of claims used in relation to cosmetic products. The new annexes on the application of the common criteria to «free from» claims (annex III) and to the claim «hypoallergenic» (annex IV) are applicable since July 2019.

Member States’ competent authorities should now monitor compliance via in-market controls, including the appropriateness and relevance of the supporting evidence for justifying the use of claims. A common approach at Union level shall facilitate administrative cooperation between the competent authorities of the Member States and prevent distortions in the internal market.
